Kaknes Landscape Supply Polices and Procedures

Kaknes Landscape Supply (KLS) is a wholesale supply yard dedicated to serving and supporting
the landscape contractors of the Seacoast and North Shore.

We accept cash and credit card payments from approved parties (Mastercard, Visa, Discover, American Express).
Overdue accounts are subject to a 1.5% per month (18% per annum) service charge, plus the
cost of collection, if necessary. A charge of $30.00 will be assessed for bad checks.
Orders picked up or delivered in Massachusetts will be charged a 6.25% sales tax unless we
have a Massachusetts or Federal Sales Tax-Exempt certificate in our files.

Catalog and Pricing

Our price lists and catalogs represent many of the items we sell, but are far from being a
complete list. As always, we enjoy working with your materials and plant lists and helping you
locate the material you want. Also, prices can fluctuate so let us give you an up-to-date
quotation on your list.

Claims (Nursery Stock)

We take great care to see that only plants in good condition leave our nursery. We certify that
plants will be true to name and free from disease when leaving the nursery. On wholesale
purchases, we do not guarantee the future growth or performance of these plants unless
advised otherwise. Our sales people are well qualified to supply proper planting & care
instruction at any time. We do not warranty nursery stock.

Returns Policy (Hardscape)

Claims for shortages, damages, and errors must be made within 24 hours of receipt of product.
Any materials that have been opened, broken, damaged or partially used cannot be returned.
After 15 days from the date of purchase, KLS will not accept any returned materials. A
restocking fee of 20% will be issued to returns of materials brought back to KLS. Any requests
for materials to be picked-up at a home or job-site, will be assessed a fee to be collected prior to the pickup.

Restocking fees will be assessed and collected prior to the pickup. Returned materials will be refunded within 45 days generally in the same manner as they were
purchased. Non-stocked, special-order items cannot be returned. Any items conveyed,
intimated or inferred that are sold as ‘clearance’, also overstocks, final sales, closeouts or
discontinued cannot be returned.

Tagging & Visitation

Customers may reserve plant and hardscape material for use on upcoming projects. We allow
wholesale customers and their professional representatives to tag plant and hardscape
material. We will not tag material with the clients of wholesale customers unless accompanied
by the wholesale customer or landscape architect. Material selected and tagged by retail
customers with our sales people will be charged retail prices. A non-refundable deposit may be
required to hold plant material. Orders can be scheduled to be picked up or delivered on our
own fleet of trucks.

Estimations on Materials Needed

At the request of the customer, KLS will make approximate estimations on materials required
for projects. KLS will give estimations and make recommendations on materials and best
practices based on prevailing site conditions and ‘sight unseen’ explanations from the
customer. These are estimations only and KLS will not be held responsible for any portions of
materials construed as either too little or too much. Customer is responsible for the final
approval and ordering of all recommended materials and may not withhold payment of any
part of this contract due to these routine occurrences.
Any modifications or change orders to above contract, must be made and fully remitted via a
sales ticket transaction.

Vehicle Ownership Indemnification

Vehicles not belonging to KLS but loaded by KLS or its associated equipment in our yards or at
other locations, are loaded at the owners or vehicle operator’s discretion. We can assume no
liability for their condition, allowance or transport ability. The Customer, its heirs and assigns
agree to indemnify and hold KLS harmless against any and all loss or claim by any person or
entity as a result of personal injury or property damage occasioned by the condition or loading
of the customer’s property.
The loading of materials into vehicles not belonging to KLS but loaded by KLS or its associated
equipment in our yards or at other locations, are subject to the use of industry accepted
standards and techniques. It is common that materials may spill out of the loader apparatus and onto vehicles stationed for loading. KLS recommends that for the safety of its customers and those associated with vehicles stationed for loading that all windows and doors remained closed while loading is occurring. Furthermore, it is common that materials will strike the vehicle during the course of loading and the owners of vehicles take precautions to protect vehicles from this routine occurence.

Special Orders & Custom Materials

• With special orders, customer must review and sign, in agreement of their approval, the
product to be received.
• Product shipment/arrival dates are approximate only and may vary. No guarantees or
warrantees of delivery dates are expressed or conveyed.
• Once complete, customer agrees to take delivery of ordered material at scheduled time.
If Customer is unable to take delivery, customer may accrue shipping/handling/storage
charges.
• Special order materials generally require a monetary deposit and payment upon
completion. Customer agrees to deposits and specific payment terms.
• Upon the payment of deposit for special order materials, the customer owns, in whole
or in part, the material. If the order is cancelled, changed or altered, no refunds of
deposits or returns of all or any partial materials is permitted.
• KLS cannot guarantee the integrity of any special-order natural stone or plant material.
Stone and plant materials are natural products, not manufactured. It holds no
manufacturer’s warrantee or specification of content, color, consistency or durability.
